By accessing and using Orcho ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.
Description of Service
Orcho is an AI risk intelligence platform that provides:
- Real-Time Risk Scoring: Scores AI tasks 0-100 for risk before execution
- Task Routing: Routes tasks based on risk level (auto-approve, human review, or block)
- Sensitive Data Detection: Identifies PII, financial data, credentials, and health information
- Analytics & Governance: Provides risk assessment reports, audit trails, and compliance tracking
- API Integration: Integrates with development and workflow platforms (Jira, GitHub, Cursor, Slack, etc.)
⚠️ Beta Testing Disclaimer
IMPORTANT: Orcho is currently in BETA TESTING.
By using this service, you acknowledge that:
- The service may contain bugs, errors, or incomplete features
- Data may be lost, corrupted, or inaccessible during the beta period
- Features and functionality may change without notice
- The service is provided "AS IS" without warranties of any kind
- We reserve the right to modify or discontinue the service at any time during beta testing
- The system is not yet fully compliant with all data protection regulations
User Accounts and Access
Account Requirements
- You must have authorized access to your organization's systems and platforms
- You must provide accurate and complete information
- You are responsible for maintaining the confidentiality of your account
- You must notify us immediately of any unauthorized use of your account
Permissions and Responsibilities
- You must have appropriate permissions in your connected platforms to use the Service
- You are responsible for all activities that occur under your account
- You must comply with your organization's policies regarding third-party applications
Acceptable Use

You may use the Service to:

Prohibited Uses
You may NOT use the Service to:

- Interfere with or disrupt the Service or servers
- Reverse engineer, decompile, or disassemble the Service

- Use the Service to facilitate harmful or dangerous AI activities
Data and Privacy
Data Ownership
- You retain ownership of all data you input into the Service
- We do not claim ownership of your task data, prompts, or organizational information
- You grant us a limited license to process your data solely to provide the Service
Data Processing
- We process your data according to our Privacy Policy
- Task data is analyzed in real-time and not permanently stored (unless audit logging is enabled)
- We implement industry-standard security measures to protect your data
- We may use anonymized, aggregated data to improve our risk models (with your consent)
Data Backup
- You are responsible for backing up your important data
- We are not liable for any data loss during the beta testing period
- If audit logging is enabled, we maintain backups according to your retention settings
Intellectual Property
Our Rights
- Orcho and all related intellectual property belong to us
- The Service, including its design, functionality, and risk scoring algorithms, is proprietary
- You may not copy, modify, or distribute the Service without permission
Your Rights
- You retain all rights to your data and content
- You may provide feedback, suggestions, or ideas about the Service
- We may use your feedback to improve the Service without compensation
Third-Party Services
Platform Integrations
- The Service integrates with various platforms (Jira, GitHub, Cursor, Slack, etc.)
- Each platform's terms of service apply to their respective services
- We comply with each platform's security and privacy requirements
- You are responsible for maintaining valid accounts and permissions with integrated platforms
Third-Party Liability
- We are not responsible for the actions, policies, or availability of third-party platforms
- Interruptions or issues with third-party platforms may affect Service functionality
Payment and Billing
Beta Testing
- The Service is currently free during the beta testing period
- We reserve the right to introduce paid plans after beta testing
- We will provide at least 30 days notice before implementing any charges
Future Billing
- Paid plans may be introduced after beta testing
- Billing terms will be clearly communicated before implementation
- Pricing will be based on usage (API calls) and features
- You may cancel your subscription at any time
Service Availability
Uptime and Reliability
- We strive to maintain high service availability but cannot guarantee 100% uptime
- The Service may be temporarily unavailable for maintenance or updates
- We are not liable for service interruptions during beta testing
- We will provide reasonable notice for planned maintenance when possible
Updates and Changes
- We may update the Service with new features or improvements
- Updates may be applied automatically
- We will notify users of significant changes when possible
- Risk scoring algorithms may be updated to improve accuracy
Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF RISK SCORES
- COMPLETENESS OF SENSITIVE DATA DETECTION
IMPORTANT: While we strive for accurate risk assessment, no system is perfect. You remain responsible for reviewing AI outputs and making final decisions about task execution.
Limitation of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR:
- ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES
- LOSS OF PROFITS, DATA, OR USE
- BUSINESS INTERRUPTION
- DAMAGES RESULTING FROM USE OR INABILITY TO USE THE SERVICE
- DAMAGES RESULTING FROM RELIANCE ON RISK SCORES OR RECOMMENDATIONS
- DAMAGES FROM UNDETECTED SENSITIVE DATA OR MISSED RISK FACTORS
Maximum Liability
Our total liability to you for any claims related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim, or $100, whichever is greater.
Your Responsibilities
You acknowledge and agree that:
- Risk scores are recommendations, not guarantees
- You remain responsible for final decisions about AI task execution
- You should implement your own security and review processes
- You are responsible for compliance with applicable laws and regulations
- You should not rely solely on the Service for security or compliance
Indemnification
You agree to indemnify and hold us harmless from any claims, damages, or expenses arising from:
- Your use of the Service
- Your violation of these Terms
- Your violation of any third-party rights
- Your violation of applicable laws or regulations
- Decisions made based on risk scores or recommendations from the Service
Termination
Termination by You
- You may stop using the Service at any time
- You may request deletion of your data (subject to legal requirements)
- Termination does not relieve you of obligations incurred before termination
Termination by Us
- We may suspend or terminate your access to the Service at any time for violation of these Terms
- We may terminate the Service entirely during beta testing
- We will provide reasonable notice when possible
Effect of Termination
- Your right to use the Service ceases immediately
- We may retain certain data as required by law or for legitimate business purposes
- Provisions that by their nature should survive termination will remain in effect
Governing Law and Disputes
Governing Law
These Terms shall be governed by and construed in accordance with the laws of Delaware, United States, without regard to conflict of law principles.
Dispute Resolution
- Any disputes shall be resolved through binding arbitration
- Arbitration shall be conducted in Delaware, United States
- You waive the right to participate in class action lawsuits

- You use the Service at your own risk
- You should not rely solely on the Service for production-critical decisions during beta
These Terms of Service are effective as of the date listed above and will remain in effect until modified or terminated.
